The Prize Market – Terms & Conditions
1. Introduction and Operator Details
1.1 These Terms and Conditions ("Terms") apply to your use of the website and all prize draws and competitions operated via The Prize Market.
1.2 The Prize Market is a trading name of The Prize Market Group Limited, a company registered in England and Wales with Company Number 16399750. Our registered office is 167-169 Great Portland Street, 5th Floor, London, England, W1W 5PF ("we", "us", "our").
1.3 Acceptance of Terms: By accessing or using our Website, registering an account, or entering a competition or draw, you ("the Entrant", "you") agree to be bound by these Terms in their entirety.
1.4 We operate two distinct types of prize promotions: "Tier 1: Free Prize Draws" (which offer a free postal entry route) and "Tier 2: Skill Prize Competitions" (which require the entrant to exercise skill, knowledge, or judgment). Neither of these models is classed as an illegal lottery or form of gambling under the Gambling Act 2005, and they do not require a licence from the Gambling Commission. Each competition page clearly indicates which Tier the promotion falls under.
1.5 Conflict of Terms: In the event of any conflict or inconsistency between these General Terms and any specific rules, limits, or details prominently displayed on an individual competition page, the specific rules on that individual competition page shall prevail for that specific promotion.
2. Eligibility and Account Rules
2.1 To register an account and enter, you must be aged 18 years or older and be a legal resident of the United Kingdom.
2.2 Individual Entries Only: Entries must be made by individuals acting on their own behalf. Entries submitted by businesses, corporate entities, syndicates, or via automated third-party services are strictly prohibited.
2.3 You will be required to formally declare your age when registering for an account.
2.4 You may only register and maintain one single account per person.
2.5 Accuracy of Information: You are solely responsible for ensuring that the personal details on your account (including your legal name, email, and address) are accurate, truthful, and kept up to date. Providing fake or inaccurate details will result in account suspension and the forfeiture of any prizes won.
2.6 Account Security: You are strictly responsible for keeping your account password and login credentials secure. We will not be liable for any loss, or any unauthorised use of your wallet credit, resulting from your failure to protect your login details.
2.7 We operate a strict "Know Your Customer" (KYC) verification policy. Before any prize can be fulfilled, or before any cash withdrawal is paid, you must successfully complete our identity and age verification process (providing valid photo ID and proof of address as requested). The legal name and details on the documents you provide must match the details registered to your account.
2.8 Our employees, directors, agents, third-party suppliers, and their immediate family members or members of the same household are prohibited from entering our promotions.
3. Site Wallet, Balances, Top-Ups, Withdrawals, and Consumer Rights
3.1 Your account holds three separate balance types, and each is treated differently:
- Cash balance — funds credited from prize winnings (cash prizes, the 70% Cash Alternative under clause 7.5, or the cash element of a Prize Credit Swap under clause 10). This balance can be withdrawn to your verified bank account subject to clause 3.9 below.
- Top-up balance (Wallet credit) — funds you deposit via our payment processor to enter paid competitions. This balance cannot be withdrawn as cash (see 3.2 and 3.3 below). It can be used only to enter promotions.
- Bonus balance — non-withdrawable promotional credit awarded for: the welcome bonus on account creation, successful referrals (clause 11), achievement badges, top-up bonuses, and other promotional offers we may run from time to time. Bonus credit can only be used to enter promotions.
3.2 Wallet credit (top-ups) cannot be exchanged or withdrawn as cash. Refunds on top-up balance are strictly limited to wholly unused top-up transactions requested within the statutory 14-day cooling-off period (see Clause 3.3). Cash winnings, by contrast, may be withdrawn under clause 3.9.
3.3 Statutory Cancellation Waiver (No Partial Refunds): Under the Consumer Contracts Regulations 2013, you have a 14-day right to cancel a digital wallet top-up, provided the funds remain entirely unused. However, if you use any portion of a specific wallet top-up to enter a live draw or competition, you expressly consent to the immediate supply of digital services. At the exact moment you place an entry, you acknowledge that you immediately lose your 14-day right to cancel, and you will not be entitled to a refund for the remainder of that specific top-up.
3.4 Fair Use and Refund Abuse: We monitor account activity. If we reasonably suspect that a user is abusing the statutory cancellation right by repeatedly depositing funds and requesting refunds without participating in competitions, we reserve the right to process the final refund and permanently terminate the account.
3.5 Chargebacks and Disputed Payments: By purchasing wallet credit and placing an entry into a promotion, you acknowledge that the digital service has been fully delivered and consumed at the exact moment your entry is confirmed. Therefore, you agree that you have no valid basis to request a chargeback from your card provider for funds that have been used to enter a draw, regardless of whether you win or lose. If you initiate an illegitimate chargeback or payment dispute:
- a) Any active or pending entries associated with those funds will be instantly voided.
- b) If you have already won a prize using the disputed funds, you will forfeit the prize immediately. If the prize has already been delivered, we reserve the right to initiate legal proceedings to recover the prize or its full monetary value from you.
- c) Your account will be permanently terminated.
- d) We will vigorously dispute the chargeback with your bank or card provider using these Terms as evidence, and we reserve the right to pursue you via a debt collection agency for the outstanding funds, plus any administration fees or bank penalties we incur as a result of your dispute.
3.6 Wallet Status: Your site wallet is a facility to facilitate entry into our promotions and to receive cash winnings; it is not a bank account. Funds held in your wallet do not accrue interest and are not protected by the Financial Services Compensation Scheme (FSCS).
3.7 Unused wallet credit (top-up and bonus balances) will expire after 12 months of complete account inactivity (meaning no logins, top-ups, or entries made within a 12-month period). We will attempt to notify you by email before your balance expires. Cash balance from winnings is not subject to this 12-month forfeiture but is subject to KYC clearance before withdrawal under clause 3.9.
3.8 If we are forced to cancel a draw or competition due to technical failure before it concludes, the equivalent wallet credit spent on that competition will be returned to your site wallet.
3.9 Withdrawals of Cash Winnings: You may request a withdrawal of your cash balance at any time, subject to:
- The withdrawal amount meeting the minimum threshold displayed at the time of request (currently £10, but variable at our discretion);
- You having successfully completed KYC verification under clause 2.7;
- Our standard processing window of up to 3 working days following request approval; and
- Our right to investigate suspicious or potentially fraudulent withdrawal requests, which may extend processing time.
4. Competition Categories, Entry Fees, and Promotions
4.1 The specific entry fee for each individual promotion will be clearly stated on the relevant competition page prior to entry.
4.2 Promotional Pricing and Flash Sales: We reserve the right to adjust entry fees, run promotional discounts, or offer bulk-buy discounts at any time during a live competition. Any such price changes or promotions will only apply to entries purchased during the promotional period. If you purchased entries prior to a price reduction or promotion, you are not entitled to a refund, site credit, or additional entries to make up the price difference.
4.3 There is no maximum limit on the number of entries any individual user may hold in a single competition, unless a specific cap is expressly stated on the individual competition page.
4.4 Confirmation of Entry: An entry is only deemed legally valid, and entered into the draw, once the required entry fee has been successfully deducted from your site wallet and an entry confirmation (such as a draw number) has been generated and displayed within your account.
5. How to Enter: Tier 1 (Free Prize Draws)
5.1 Tier 1 Promotions are operated as free prize draws. They do not require a skill question. You may enter these via the paid route (using wallet credit) or via the free postal route.
5.2 Paid Route: Select your entries on the competition page and confirm. The cost will be deducted from your wallet, and your draw numbers will be allocated immediately.
5.3 Free Postal Route: You may enter Tier 1 draws for free via post. Postal entries carry an identical chance of winning as paid entries. To enter for free, you must register for a free account on our Website and access the Free Postal Entry Instructions located within your account dashboard.
5.4 You must strictly follow the formatting, data requirements, and mailing instructions generated on your specific postal entry template.
5.5 Postal Entry Processing Conditions: To protect the integrity of the draws, the following strict legal conditions apply to all postal entries:
- One entry per envelope: Each individual postal entry must be submitted in its own separate, stamped envelope. Bulk entries shipped in a single envelope will be entirely disqualified.
- Processing Deadline: Postal entries must be physically received by us at the designated address at least 48 hours before the draw closes to allow time for processing. Entries received after this cut-off will not be entered into the draw.
6. How to Enter: Tier 2 (Skill Prize Competitions)
6.1 Tier 2 Promotions are operated as skill-based prize competitions. There is no free postal entry route for Tier 2 promotions.
6.2 To enter a Tier 2 competition, you must pay the applicable entry fee using your wallet credit and use your skill, knowledge, or judgment to successfully complete the skill-based challenge, puzzle, or question presented at the point of entry.
6.3 Incorrect Answers: If you fail to successfully complete the skill challenge or answer the question incorrectly, your wallet will still be charged the entry fee, but your entry will be voided and will not be entered into the final draw. No refunds will be given for incorrect answers. A clear disclaimer will be displayed prior to entry confirming this rule.
6.4 Final Decision: The correct answer or successful completion of the skill challenge will be determined solely by us. Our decision as to the correct answer is final, binding, and not subject to appeal or dispute.
7. Timers, Thresholds, Guaranteed Draws, and Rollovers
7.1 Closing Dates and Early Closure: Each competition will have a stated closing date and a countdown timer. However, if a competition reaches its maximum entry limit (sells out) before the timer expires, we reserve the right to close the competition early and bring the draw date forward.
7.2 Guaranteed Draws: Some promotions may be clearly marked as a "Guaranteed Draw". For these promotions, the draw will take place on the stated closing date (or earlier if sold out) regardless of the number of entries sold. No minimum threshold or rollovers will apply.
7.3 Threshold Draws and Rollovers: Other promotions may feature a minimum entry threshold. For these promotions, if the timer expires before the minimum threshold is met, we reserve the right to extend the timer (a "Rollover").
7.4 Maximum Rollovers: A competition timer may be extended a maximum of two (2) times (i.e. an initial Leg 1 plus up to two further Legs).
7.5 70% Cash Alternative: If, after the second and final rollover period expires, the minimum entry threshold is still not met, the draw will take place as normal. However, instead of awarding the stated physical prize, the winner will be awarded a cash alternative equal to 70% of the total paid entry fees collected for that specific competition, paid into their cash wallet balance and withdrawable to their verified bank account under clause 3.9 (subject to KYC). The remaining 30% is retained by us to cover marketing, administration, and payment processing costs. For the avoidance of doubt, the cash alternative is calculated solely on actual funds received, not on the retail value of the prize, and this calculation applies equally to all valid winners, including those who entered via a free postal route.
8. Draw Process and Verifiable Randomness
8.1 Selection: Winners are selected purely at random from all valid entries (including valid postal entries for Tier 1, and valid, correct skill entries for Tier 2) using the Random.org Signed API — a third-party random-number generator provider that is widely recognised across the gaming industry for cryptographically signing each result.
8.2 Independent Verification: For every draw completed via Random.org's Signed API, we publish:
- The draw reference number,
- The Random.org serial number allocated to the draw,
- A cryptographic signature, and
- A direct verification link that any member of the public may follow to independently verify, on Random.org's own servers, that the result was generated genuinely at random and has not been tampered with after the fact.
These verification links are published on our public Winners page following each completed draw.
8.3 Local Fallback: In the rare event that the Random.org service is unavailable (e.g. due to network failure or quota exhaustion), we will fall back to a local cryptographically secure pseudo-random number generator (Python secrets, CSPRNG). Where this local fallback is used, the draw record will be clearly tagged as such on our Winners page. We commit to investigating and remediating any such fallback event within 48 hours.
8.4 Timing of the Draw: The draw will take place as soon as reasonably possible, and typically within 48 hours of the competition's closing date and time. The exact draw date and time may be communicated on our Website or social media channels.
8.5 Live Broadcasts: We may choose to broadcast the RNG draw live on our Website or social media platforms. In the event of a technical failure, internet drop-out, or platform crash during a live broadcast, the underlying draw and the RNG result generated will remain completely valid and legally binding. We will publish a recording or the verified result (and corresponding Random.org verification link) as soon as the technical issue is resolved.
8.6 Final Decision: The result of the RNG is absolute and final. No correspondence, disputes, or negotiations will be entered into regarding the outcome of any draw.
8.7 Publication: Draw results, including the winning draw reference number and (where applicable) the Random.org verification link, will be published publicly on our Website following the conclusion of the draw.
9. Winner Selection, Notification, and Verification
9.1 Notification: We will attempt to contact the winner using the email address and/or telephone number registered to their account within 48 hours of the draw concluding. It is your sole responsibility to ensure your contact details are up to date and to routinely check your email spam/junk folders.
9.2 Claim Period: The winner has exactly fourteen (14) days from the date of our initial notification attempt to respond and claim their prize.
9.3 Verification (KYC): To claim the prize, the winner must successfully complete our identity and age verification process. This will require providing a valid, unexpired photo ID and proof of address. The legal name and details on these documents must perfectly match the details registered on the winning account.
9.4 Forfeiture: If a winner fails to respond within the 14-day claim period, fails the KYC verification, provides mismatched details, or is found to have breached any of these Terms, they will immediately and irrevocably forfeit their entire right to the prize.
9.5 Redraws: In the event of a prize forfeiture, we reserve the right to redraw the competition from the remaining valid entries to select an alternative winner. We may repeat this process at our sole discretion until a fully verified winner is confirmed, or we may choose to withdraw the prize if reasonable attempts to find a valid winner have been exhausted.
10. Prize Fulfilment, Warranties, and Credit Swap
10.1 Physical prizes will be fulfilled and delivered to the winner's verified address within 28 days of successful identity verification. Delivery is free to UK addresses.
10.2 Warranties: All physical prizes are awarded "as is". We do not provide any direct warranties, guarantees, or representations regarding the condition or fitness for purpose of any prize. Any manufacturer warranties are transferred to the winner, and any faults or defects must be raised directly with the manufacturer.
10.3 We reserve the right to substitute any prize with a reasonable equivalent of equal or greater value if circumstances beyond our control make it necessary.
10.4 Prize Cash Swap: Upon winning, a winner may elect to refuse the physical prize and instead receive a cash equivalent paid into their wallet's cash balance (withdrawable under clause 3.9 subject to KYC).
10.5 If the cash swap is selected, an exchange fee may be deducted from the credited amount to reflect the costs already incurred in sourcing the physical prize. The exact fee applied will be clearly communicated to you before you confirm the swap.
11. Referral Programme
11.1 Users may refer friends using their unique referral link.
11.2 Qualifying Referrals: A successful referral occurs when the referred friend (who must be an entirely new user who has never previously held an account with us) creates an account and successfully spends the required minimum threshold on entries.
11.3 Upon a successful referral, the referring user will receive a bonus credit added to their bonus wallet balance. As bonus credit, this referral reward is not withdrawable for cash and may only be used to enter promotions. The exact bonus amount and the required minimum spend threshold will be clearly detailed on our Referral Programme page.
11.4 Referral credit (and all bonus credit generally) is non-withdrawable, cannot be exchanged for cash, and is solely for use on future entries.
11.5 Fraud and Clawbacks: Only one referral bonus will be awarded per referred user. Self-referrals, referring members of your own household, or the creation of fake accounts to abuse this programme will result in immediate account suspension and the forfeiture of all wallet credit. Furthermore, if a referred friend subsequently issues a chargeback or receives a refund for their qualifying spend, we reserve the right to immediately void and claw back the referral bonus from the referring user's wallet.
11.6 Right to Amend: We reserve the right to amend, pause, or permanently terminate the Referral Programme at any time, for any reason, at our sole discretion.
12. Free Promotional Draws, Achievement Badges, and VIP Tiers
12.1 Free Draws. We may, from time to time, operate free promotional draws (such as a daily or weekly free draw). Where offered, no payment or wallet credit deduction will ever be required to enter a free promotional draw. The specific eligibility requirements, frequency of the draws, and available prizes will be clearly detailed on the relevant promotional page on our Website at the time of entry.
12.2 Achievement Badges. We operate a non-cash loyalty programme in which users may earn Achievement Badges for reaching certain milestones (e.g. first entry, first win, sustained activity). Some badges may carry a small bonus-credit reward, which is governed by the same non-withdrawable rules as all bonus balance under clauses 3.1 and 11.4. The badges programme is at our sole discretion and may be modified, paused, or terminated at any time without notice.
12.3 VIP Tiers. We operate a non-monetary VIP-tier programme (Bronze, Silver, Gold, Platinum) which evaluates a user's tier based on lifetime entry spend over a rolling window. Tiers may unlock perks such as enhanced top-up bonuses, early access to selected competitions, and dedicated support channels. The exact tier-spend thresholds, perks, and evaluation window are displayed within your account and may be amended at any time at our sole discretion. Top-up bonuses awarded as part of VIP-tier perks are paid as bonus credit and are subject to clauses 3.1 and 11.4.
13. Prohibited Conduct and Account Suspension
13.1 We reserve the right to suspend or permanently close your account without notice if we reasonably suspect you are in breach of these Terms or are engaging in prohibited conduct. Prohibited conduct includes, but is not limited to:
- Creating multiple accounts to bypass entry limits or abuse promotions.
- Providing false, fraudulent, or misleading information.
- Attempting to hack, interfere with, or manipulate the RNG system or Website.
- Using automated software, bots, or scripts to submit entries or interact with the Website.
- Using stolen payment methods, initiating fraudulent chargebacks, or engaging in suspicious financial activity.
- Abusing the referral programme, the achievement badge programme, the VIP-tier programme, or any other promotional feature.
13.2 If your account is terminated for prohibited conduct, you will forfeit any remaining wallet credit, bonus balance, unwithdrawn cash balance, and any pending prizes.
14. Intellectual Property and User Content
14.1 Our IP: All content on our Website, including but not limited to text, graphics, logos, images, software, audio clips, and database rights, is the property of The Prize Market Group Limited or our content suppliers, and is protected by UK and international copyright and trademark laws. You may not reproduce, duplicate, copy, sell, or exploit any portion of the Website or our brand identity without our express written permission.
14.2 Winner Content: If you win a promotion and subsequently provide us with photographs, videos, or testimonials ("User Content"), you grant us a perpetual, royalty-free, worldwide, non-exclusive licence to use, reproduce, and display such User Content for marketing and promotional purposes across our Website and social media channels.
15. Data Protection, Winner Publication, and Taxes
15.1 Data Protection: We process your personal data in accordance with the UK GDPR and the Data Protection Act 2018. For full details on how your data is handled, stored, and protected, please refer to our Privacy Policy.
15.2 Winner Information (ASA Rules): To comply with the Advertising Standards Authority (ASA) CAP Code, we are legally required to demonstrate that a valid award took place. To protect our users' privacy, we do not publicly publish winner details by default. Instead, we publish a draw reference number (and where available, a Random.org verification link) on our Winners page, and will make the surname and county of major prize winners available upon request to anyone who contacts us within 30 days of a draw closing. If you win, you have the right to object to your surname and county being made available in this way, or to request that the amount of information made available is reduced. Regardless of any objection, we must still provide your full winning details directly to the ASA if challenged by them to prove the draw was conducted fairly.
15.3 Taxes: The payment of any local or national taxes relating to the receipt or use of any prize is the sole responsibility of the winner. We accept no liability for any tax implications arising from winning a prize.
16. Limitation of Liability
16.1 Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation.
16.2 To the fullest extent permitted by law, we will not be liable for any loss or damage (whether direct, indirect, special, or consequential) arising from:
- Website downtime, technical faults, bugs, viruses, or server errors.
- Delayed, lost, misdirected, or damaged postal entries.
- Delays or failures in prize delivery caused by third-party delivery partners, couriers, or manufacturers.
- Your subsequent use, misuse, or inability to use any prize once delivered.
- Temporary unavailability of the Random.org Signed API (in which case clause 8.3 governs).
16.3 Our total maximum liability to you in respect of any single promotion is strictly limited to the value of the entry fees you paid for that specific promotion.
17. Amendments to these Terms
17.1 We reserve the right to update, amend, or replace any part of these Terms at any time.
17.2 Protection of Live Entries: Any changes made to these Terms will not apply retroactively to any live promotion you have already entered. The Terms and rules in place at the exact time of your entry will govern that specific entry.
17.3 Notification of Changes: For minor updates, we will post the revised Terms to this Website. For material changes that significantly affect your rights, wallet balance, or account, we will notify you directly (for example, via email or a prominent account notification) before the changes take effect. Your continued use of the Website or participation in new promotions following such notification constitutes acceptance of the new Terms.
18. Governing Law and Jurisdiction
18.1 These Terms, and any dispute or claim arising out of or in connection with them, shall be governed by and construed in accordance with the laws of England and Wales.
18.2 As a consumer, you may bring legal proceedings in respect of these Terms or our promotions in the courts of England and Wales. However, if you are a resident of Scotland, you may bring legal proceedings in either the Scottish or the English courts. If you are a resident of Northern Ireland, you may bring legal proceedings in either the Northern Irish or the English courts.
